Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Portfolio Management System operated by peelpot.co.uk ("we", "us", "our") (the "System"). By accessing or using the System, you agree to be bound by these Terms. If you do not agree, do not use the System.

1. Operator

The System is operated by Darren Bassett trading as peelpot, based in England, United Kingdom.

2. Eligibility

The System is intended for use by adults (18 years or over) in a professional or educational context. Access is granted by an administrator as part of a learning programme. You must not create or use an account unless you have been authorised to do so.

3. Access

Access to the System is provided as part of an educational programme arrangement. We reserve the right to modify, restrict, or withdraw access to the System at any time for operational, security, or legal reasons. Where possible, we will provide reasonable notice of planned changes.

4. User Accounts

  • Your account is personal to you. You must not share your login credentials with anyone else or allow another person to use your account.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account.
  • You must notify us immediately if you suspect unauthorised use of your account: dnbassett@peelpot.co.uk
  • You must provide accurate information when your account is set up and keep it up to date.

We may suspend or terminate accounts for violations of these Terms or the Acceptable Use Policy.

5. Uploaded Content and Submissions

  • You retain ownership of the content you upload (portfolio evidence, assignment submissions, and similar material).
  • By uploading content, you grant us a non-exclusive licence to host, store, display, and process your content as necessary to provide the System to you and to enable tutors, assessors, and administrators to carry out their programme functions.
  • This licence ends when your content is deleted in accordance with our Data Retention Policy.
  • You are solely responsible for your uploaded content. You represent that it does not infringe third-party rights and complies with our Acceptable Use Policy.
  • Uploaded files are scanned for viruses and malware. Files identified as harmful or unsuitable may be quarantined from user access and may be permanently deleted following administrative review.
  • Where enabled, uploaded files are encrypted at rest using AES-256-GCM.

6. Acceptable Use

Your use of the System must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Prohibited activities include but are not limited to: academic dishonesty, impersonation, harassment, and attempts to circumvent security controls.

7. Academic Integrity

All evidence, assignment responses, and examination answers submitted through the System must be your own work unless collaboration is explicitly permitted. We reserve the right to refer suspected academic misconduct to your programme administrator or institution.

8. System Activity Logging

All actions taken within the System are logged for security, accountability, and audit purposes. By using the System, you acknowledge and accept this logging. Full details are in our Privacy Policy.

9. Intellectual Property

All System content excluding user-uploaded material (including design, code, curriculum frameworks, and branding) is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute it without written permission.

10. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy and Data Retention Policy, which comply with the UK GDPR and Data Protection Act 2018.

11. Disclaimer of Warranties

The System is provided "as is" and "as available". We make reasonable efforts to maintain availability and accuracy, but we do not guarantee uninterrupted access, error-free operation, or that all content will be permanently stored. Scheduled maintenance may cause temporary unavailability.

12. Limitation of Liability

To the fullest extent permitted by UK law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the System. Our total liability shall not exceed £100, except where liability cannot be limited by law (such as for personal injury caused by negligence, or fraud).

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

13. Termination

We may suspend or terminate your account at any time for breach of these Terms, for security reasons, or at the request of your programme administrator. You may request account deletion by contacting us at dnbassett@peelpot.co.uk. Upon termination, your content will be deleted in line with our Data Retention Policy.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the System or by email. Continued use after notification constitutes acceptance. Where required by law, we will seek fresh consent before processing your data under any new terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
